TERMS AND CONDITIONS OF 3M BIG SPENDER CONTEST
In conjunction with 3M Malaysia Sdn Bhd’s (hereby known as “3M”) 50th anniversary, 3M will be organizing the 3M Big Spender Contest. The 3M Big Spender Contest is a points reward system to reward its top 50 participants on Lelong.my ("Official 3M Store") by the end of the Contest Period. Contestants are deemed to have read, understood and agreed to be bound by these Terms and Conditions.
1. Eligibility
1.1
This contest is open to all residents of Malaysia aged 18 years old and above (including permanent residents or expatriates who are currently living in Malaysia), except for the following:-
1.1.1
Permanent and/or contract employees of 3M (including its subsidiaries and related companies) and their immediate family members; and
1.1.2
Representatives and/or agents (including advertising and promotion agents) of 3M and its subsidiaries and related companies, and their immediate family members. The phrase “immediate family members” refers to children, parents, spouses, brothers and sisters of the above group of individuals. Should any person listed above is identified as the contestant, such person will be automatically disqualified from the contest.
1.2
All Lelong.my users will automatically be registered as Contestants of the Contest and will be rewarded points according to the points system when they purchase any 3M products from the Official 3M Store throughout the Contest Period.
2. Contest Period
2.1
The Contest will commence from 13/11/2017 until 01/01/2018 (hereby known as “Contest Period”).
2.2
Any purchases made before and after the Contest Period will not be taken into consideration.
3. Points System
3.1
Contestants are only entitled to points when any 3M products are purchased from the Official 3M Store throughout the Contest Period.
3.2
For any 3M products purchased on Official 3M Store, Contestants will receive 1 point for every RM1.00 spent. Only the Ringgit value will be converted into points and the cents value will be disregarded. For e.g. RM13.57 = 13 points.
3.3
The points will be calculated based on the value of the 3M products only. Additional fees such as shipping fees will not be calculated for the purposes of the points system.
3.4
Contestant who purchases the 3M products will receive a discount code via e-mail after their first purchase within the Contest Period. The Contestant is entitled to use the discount code to enjoy 10% discount on its subsequent purchases of 3M products within the Contest Period. The discount code may be shared to any person (“Subsequent Contestant”) and can be used for unlimited amount of times by both Contestant and Subsequent Contestant. Any Subsequent Contestant who uses the discount code to purchase 3M products from the Official 3M Store will also enjoy 10% discount on any purchase of 3M products. Where a Subsequent Contestant purchases 3M products, both the Contestant and Subsequent Contestant will be awarded points based on Clauses 3.2 and 3.3. The Subsequent Conestant will receive a separate discount code via e-mail after their first purchase within the Contest Period.
3.5
Additional points will be offered during Bonus Points Promotion throughout the Contest and during that period Contestants will receive 2 points for every RM1.00 spent.
For e.g.
Normal price: RM100.00, Discounted Price: RM80.00 = 80 points
Bonus Points Promotion: RM80.00 x 2 = 160 points
3.5.1 Bonus Points Promotion comprises of:
All 3M products will be worth 2 points for every RM1.00 spent for an allocated 50 minutes.
For each week of the Contest Period there will be a 3M product or bundle on sale at a discounted price. The 3M product and bundle will be worth 2 points for every RM1.00 spent.
If the Special Weekly Products are purchased during the 50 Minutes Bonus Round, the points will be calculated according to the Special Weekly Products only and Contestants will not be compensated twice.
3.6
If a Contestant disputes a transaction (for e.g. if the Contestant alleges that a transaction has not been made or reverses a transaction), the Contestant will be deemed to have waived its rights to receive the points of that particular disputed or reversed transaction.
3.7
The points cannot be transferred to any other party.
4. Contestant’s Responsibilities
4.1
The Contestant must ensure that all details given for the purpose of this Contest are true, correct and accurate. The Contestant must also ensure that the telephone number provided is in existence and are contactable. 3M reserves the rights to verify the information provided by the Contestant to Lelong.my in any form it deems fit.
5. Selection of Winner(s)
5.1
Selection of winners will be based on the following criteria(s):

Top 50 Contestants with the highest accumulated points on closing date of the Contest.
•
In the event of a tie, the Contestant that achieved the higher points earliest will be given priority.
5.2
3M’s decision in determining and selecting the winners for the Contest is final. No appeal, review, dispute of such decision will be entertained.
6. Notification of Contest Winners
6.1
Contestants’ points and rankings will be updated on a daily basis on Lelong.my. Points and rankings can be checked in the Contestant’s My Lelong account.
6.2
The Top 50 Contestants will be announced within five (5) to ten (10) working days after the end of the Contest Period.
7. Contest Prizes
7.1
The details of the Contest prizes are available via Lelong.my’s website at http://www.lelong.com.my/3m50.
7.2
All prizes are not transferable, non‐refundable and non‐exchangeable/redeemable for cash, credit or rebate of any kind and do not include any accessories or items shown in any advertisements and/or promotional materials (which are for illustration purposes only).
7.3
All prizes are subject to availability and 3M reserves the rights, without prior notice or assigning any reason whatsoever and has sole discretion to substitute any prize with other prizes of similar value without prior notice and without giving any compensation to the winners.
7.4
Contest winners who are residing within the Klang Valley area are required to collect their prizes from 3M Malaysia Sdn. Bhd. Contest winners who are residing outside the Klang Valley area may request for a delivery service from 3M.
7.5
The prize must be claimed by the winner in person.
8. Communications
8.1
All Contest communications will be sent to the Contestant’s at the e-mail address which have been provided to Lelong.my upon registration.
8.2
Communications will be deemed to have been received by the Contestants if sent to that address, 1 business day after sending if 3M/Lelong.my sent it to the e-mail address provided. Contestants are responsible for keeping their email address current.
9.Copyright, Announcement and Confidentiality
9.1
By entering this Contest, the Contestant and/or winner hereby grant 3M perpetual and non-exclusive rights to broadcast the names, pictures or images or display any matter related to the Contestant and/or winner for publicity, advertising, trade or promotional purposes in any media without further notice to the Contestant or winner. The Contestant and/or winner are not entitled to claim any payment in any form, fee or compensation for the use of their images or details in relation to the above.
9.2
The Contestant and/or winner acknowledge, understand and agree that their details may be used and shared by 3M for the purposes of the Contest. Any Contestant’s information or personal data (“Personal Data”) provided by the Contestant to 3M or Lelong.my in connection with the Contest shall be kept confidential except to any activities mentioned thereto. 3M commits to take all reasonable precautions to preserve the integrity and prevent any corruption or loss, damage or destruction of Contestant’s Personal Data and comply with the requirement of Personal Data Protection Act 2010. By participating in this Contest, the Contestant has provided its consent to 3M to process its Personal Data in the manner as set out in 3M Malaysia’s Privacy Policy which can be viewed at http://www.3m.com.my/3M/en_MY/company-my/privacy-policy/.
10. Variation to the Terms and Conditions
10.1
3M reserves the rights to change, amend, delete or add to these Terms and Conditions either in written or verbal communications without prior notice at any time.
10.2
In the event of any dispute, conflict, uncertainty or ambiguity relating to the Terms and Conditions hereto, or any matter involving this Contest, 3M will resolve the matter in its absolute discretion, which shall be conclusive and final.
11. Liability
11.1
To the fullest extent permitted by law, 3M makes no representations or warranties with respect to any prizes provided under this Contest; in particular, 3M gives no warranty on merchantable quality, or fitness for purpose of the prizes.
11.2
The Contestant defends, indemnifies and hold 3M harmless from any demands, claims, suits or actions arising from or in connection with any death, personal injury, loss of or damage to property suffered by the Contestant or any third party as a result of the use of the prize, regardless of cause and the Contestant agrees to assume the sole liability.
12. Disqualification
12.1
3M reserves the right at its sole discretion and without having to assign any reason whatsoever, to disqualify any Contestant for the following:
12.2
The decision to disqualify shall be final and no correspondence shall be entertained.
13. Suspension, Cancellation or Termination of Contest
13.1
3M reserves the right to cancel, suspend, delay or terminate the Contest at its absolute discretion without giving prior written notice to the Contestant or in the event of unforeseen circumstances beyond its reasonable control.
13.2
In the event of suspension, cancellation, delay or termination of the Contest for any reason by 3M, the Contestant or the winner shall not be entitled to make any claim or claim for compensation from 3M and/or Lelong.my for any loss or damages suffered or incurred as a direct or indirect result of the suspension, cancellation, delay or termination of the Contest.
14. Governing Law and Jurisdiction
This Terms and Conditions are governed by the laws of Malaysia and any dispute arising out of or in connection with them shall subject to the exclusive jurisdiction of the courts in Malaysia.
